These Terms of Service (“Terms”) are a legal agreement between you and Minbar LLC (“Minbar,” “we,” “us”). They govern your use of the Minbar websites, mobile apps, and services (together, the “Service”). By creating an account or using the Service you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.
1. Who can use Minbar
You must be at least 13 years old to use the Service. You must have the legal capacity to enter into a binding contract where you live; if you are a minor under your local law, you must have a parent or legal guardian’s permission before creating an account.
If you register on behalf of a masjid, organization, or other entity, you represent that you have authority to bind that entity to these Terms, and references to “you” include that entity.
2. Your account
- Keep your login credentials secure. You are responsible for all activity under your account.
- Provide accurate information and keep it up to date.
- One account per person. Do not impersonate anyone else.
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used to harm the Service or other users.
3. Roles within a masjid
When you join a masjid on Minbar you may be a member, moderator, admin, or group admin. Admins control masjid settings and membership; moderators manage content; group admins manage their own groups; members participate. Joining a masjid is typically by invite link, QR code, or approved request. You can leave a masjid at any time from Settings › My Masjids.
4. If you run a masjid on Minbar (admin responsibilities)
When your masjid uses Minbar to manage its community, Minbar acts as a service provider and data processor, and your masjid is the data controller for its members’ information. You agree that:
- You have the authority to represent the masjid and to bind it to these Terms.
- You will obtain any consents required by law before collecting member information through the Service and will give your members an appropriate privacy notice.
- You are responsible for the content your masjid posts and for moderating it consistently with our Acceptable Use Policy.
- You are responsible for complying with laws that apply to your organization, including nonprofit, tax, accessibility, and data-protection laws in your jurisdiction.
- You will not use the Service to collect health, financial, government identification, or other sensitive personal data beyond what is needed for normal community operations.
- You authorize us to engage the subprocessors listed in our Privacy Policy to operate the Service on your behalf, and to use industry-standard security measures.
- On termination or non-renewal, we will delete your masjid’s data within 90 days unless the law requires us to keep it longer.
- You will keep your billing contact and payment method current.
5. Subscriptions and billing
- Minbar offers Community (free), Growth, and Foundation tiers. Current features and prices are listed on minbar.one.
- Paid subscriptions are billed in advance, monthly or annually, through Stripe. Prices are exclusive of applicable taxes.
- Subscriptions renew automatically at the end of each term unless canceled.
- Refunds. Subscription fees are generally non-refundable. We consider refund requests for the unused portion of an annual term at our discretion; email support@minbar.one. Monthly subscriptions are not refunded.
- Price changes. We may change prices with at least 30 days’ notice before your next renewal.
- Past-due. If a payment fails we will retry and contact you. After a short grace period we may restrict access to paid features until payment is received.
- Cancellation. You can cancel at any time. Cancellation takes effect at the end of the current billing period. After cancellation, your masjid’s data is retained for 90 days to allow reactivation, then deleted.
6. Free tier
The free Community tier has feature and usage limits that we may change from time to time. We may also impose reasonable fair-use limits to protect the Service. We will not intentionally degrade the free tier without notice.
7. Your content; license you grant us
You keep ownership of the content you post on the Service — announcements, events, messages, images, profile details, and anything else you submit (“User Content”). To operate the Service we need a license from you:
You grant Minbar a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, adapt (for example, to resize images), and display your User Content, only as needed to provide the Service to you and to the masjid communities you choose to share it with. This license ends when you delete your content or your account, except for backups we may retain for a reasonable period and for copies others already have in their devices or inboxes.
You represent that you have the rights to your User Content and that it does not infringe anyone else’s rights or violate any law.
8. Content shared with a masjid
When you post to a masjid — as a member, admin, or visitor through a contact form — your content becomes visible to the admins and members of that masjid based on its settings. That content may be moderated, edited, or removed by that masjid’s admins. If your content appears on the masjid’s public website, it may be visible to anyone on the internet.
9. Acceptable use
You agree to our Acceptable Use Policy, which is part of these Terms. Among other things, you agree not to harass, spam, impersonate, distribute malware, post illegal content, or interfere with the Service. We may remove content, suspend or terminate accounts, and cooperate with law enforcement to enforce our policies.
10. Intellectual property
The Minbar name, logo, designs, source code, templates, website layouts, and the Service itself are owned by Minbar LLC and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service in accordance with these Terms. You may not copy our software, scrape or bulk-download data from the Service, reverse-engineer it, or use the Service in a way that circumvents our tier limits or otherwise violates these Terms.
11. Feedback
If you send us ideas, suggestions, or feedback, we may use them without obligation or payment to you.
12. Prayer time disclaimer
Prayer times on the Service are computed from the masjid’s coordinates and the calculation method its admins choose. Astronomical calculations are approximations, clocks drift, and local scholarship varies. Treat Minbar’s prayer times as informational guidance, not a definitive religious ruling. For questions about observance, consult your masjid’s leadership.
13. Masjid directory disclaimer
Masjid listings in the directory may include community-contributed or publicly sourced information that has not been verified by the masjid’s own leadership. Until a masjid is claimed by its admins, its information may be out of date. Minbar is not affiliated with or endorsed by any individual masjid unless expressly stated.
14. Third-party services
The Service links to third-party services (for example, Stripe for payments, Google Maps for directions, social networks linked from masjid profiles). Those services have their own terms and privacy policies and are not controlled by us. Your use of those services is at your own risk.
15. Termination
- You may delete your account at any time from Settings.
- We may suspend or terminate your access if you violate these Terms, if required by law, or if continuing to serve you would harm other users or the Service.
- Sections that by their nature should survive (ownership, licenses, disclaimers, limitations, dispute resolution) survive termination.
16. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT ALLOWED BY LAW, MINBAR AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ABOUT ACCURACY, UPTIME, SECURITY, OR SPECIFIC RESULTS.
We do not warrant that prayer times are correct to the second, that notifications will be delivered instantly, that the Service will be uninterrupted, or that content posted by other users is accurate or lawful.
17. Limitation of liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW, MINBAR AND ITS AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, GOODWILL, OR DATA, EVEN IF WE WERE ADVISED SUCH DAMAGES WERE POSSIBLE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) ONE HUNDRED U.S. DOLLARS (US$100) OR (b) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow these limitations; in those places, the above applies to the fullest extent permitted by law.
18. Dispute resolution
Informal resolution. Before filing any formal claim, please email support@minbar.one with a description of the dispute. We will work with you in good faith for 60 days to resolve it.
19. Governing law and venue
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws rules. Any dispute not resolved informally must be brought exclusively in the state or federal courts located in Wisconsin, and you and Minbar consent to personal jurisdiction in those courts.
20. Changes to these Terms
We may update these Terms. Material changes will be announced by email or a prominent in-app notice. Continued use of the Service after the stated effective date means you accept the changes. If you do not agree, stop using the Service and delete your account.
21. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and Acceptable Use Policy, are the entire agreement between you and Minbar regarding the Service.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Severability. If any provision is found unenforceable, the remainder stays in effect.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Export and sanctions. You represent that you are not on any U.S. government sanctions list and will not use the Service from an embargoed country.
